Introduction
These Terms and Conditions outline the agreement between The Legal Tax Advisory Ltd (“we,” “us,” “our”) and our clients (“you,” “your”) regarding our services for claiming back National Insurance Contributions (NICs) and related tax services.
Services Provided
We assist clients in reclaiming overpaid NICs and provide tax-related services, including:
Client Responsibilities
You must provide accurate and complete information necessary for the claim.
You are responsible for supplying all required documentation in a timely manner.
You must notify us of any changes to your circumstances that may affect your claim.
Fees
Our fees for services will be 30% of the total claim amount, including any interest.
Fees will be deducted from the total amount reclaimed once the claim is successfully processed.
If a claim is unsuccessful, you will not be charged any fees.
No Win No Fee Clause
A “win” under this No Win No Fee agreement is defined as the successful recovery of funds from HM Revenue and Customs (HMRC) for the client.
Our fees will be applicable as soon as any funds are received from HMRC as a result of the claim submitted on your behalf.
If no funds are recovered from HMRC, you will not incur any fees under this agreement.
Authorisation
By engaging our services, you grant us permission to act on your behalf in matters related to your NIC claim, including communication with HMRC.
Processing Time
We aim to submit claims within 2 weeks after receiving all necessary documentation.
Processing times may vary based on HMRC’s timelines, and we cannot guarantee specific outcomes or timeframes.
Confidentiality
We will treat all personal information you provide as confidential and will only use it to process your claim.
We will not share your information with third parties without your consent, unless required by law.
Client Liability for Tax Services
You acknowledge that you are ultimately responsible for your own tax obligations, including NICs and any other related taxes.
You agree to indemnify and hold The Legal Tax Advisory Ltd harmless from any claims, losses, or penalties that may arise from your failure to meet your tax obligations.
Acceptance of HMRC Issue 114 Agent Update
By engaging our services, you confirm that you understand and accept the requirements outlined in HMRC’s Issue 114 Agent Update, including any obligations and responsibilities it imposes on you as a client.
Limitation of Liability
While we strive to provide accurate and timely services, we cannot be held liable for:
Termination
You may terminate this agreement at any time during the cool-off period of 14 days.
We may also terminate our services if you fail to meet your responsibilities or provide false information.
Any termination shall be carried out by written notice.
Governing Law
These Terms and Conditions are governed by the laws of the United Kingdom.
Changes to Terms
We reserve the right to amend these Terms and Conditions.
You will be notified of any significant changes via email or through our website.
